Wedding Minister Certification and Training Program Work Study Contract Client Name: Address: City/State: Zip: Home Phone: Business Phone: Cell Phone: THIS AGREEMENT is entered into by and between Wedding Ministers, Inc. and Wedding Ministers, Inc. agrees to provide the following Service(s): ____ The Wedding Minister Certification Training Program -- Wedding ministerial training services, including the supply and delivery of required textbooks, to Client for the purpose of acquiring or increasing professional wedding ministry competence and education in the pursuit of Wedding Minister Certification offered by Wedding Ministers, Inc. ($2,150 over 12 months). NOTE: Services promised and provided for in this Agreement pertain only to the training Program for Wedding Minister Certification rather than Wedding Minister Certification itself. ____ Web hosting services for a period of 12 months commencing upon date of Agreement. ____ Standard Package, Complete Web Design Package, including sub-domain, basic marketing service, basic optimization, business domain e-mail account, site statistics, contact form linked to Client e-mail account, three to seven custom-designed pages, custom menu with rollover links, up to ten photos enhanced and optimized, thirty days free maintenance and updates, receive payments page with PayPal link, and three months Featured Listing on WeddingMinisters.com state, region, or metro area page. ($897) ____ Additional nine months Featured Listing on WeddingMinisters.com state, region, or metro area page. ($225) The Client agrees to pay Wedding Ministers, Inc.: Option 1 ____ $2,997 Standard Work Study Program Option 2 ____ $2,375 Limited Work Study Program (only by pre-arranged agreement with Wedding Ministers, Inc.) Client responsible for web hosting, design, and other marketing services, subject to approval of Wedding Ministers, Inc. and/or the Program director. Terms of Payment Upon written acceptance of this Agreement, Client thereupon agrees to submit credit card information (or other agreed-upon security) to Wedding Ministers, Inc. Client further authorizes Wedding Ministers to initiate charges to the credit or debit card provided by the Client twelve (12) months from the date of written acceptance of this Agreement equal to the sum of all unpaid tuition and applicable costs. Client shall pay Wedding Ministers, Inc. $ __________ upon signing this Agreement and the remaining amount of $_____________ due in payments equal to revenues generated and received by Client in the course of booking and performing weddings, until balance paid in full. Payments to Wedding Ministers, Inc., are due and payable within ten (10) days of Client’s receipt of payment including, but not limited to, advanced deposit for securing minister and date, payments made prior to wedding date, and final payment in full no later than day of wedding, for wedding ministry services and associated fees contracted and/or provided to Client wedding customers. Failure on the part of the Client to inform the Program directory of bookings and/or received revenues from bookings and remit payments due Wedding Ministers according to the terms of this agreement shall constitute default on the terms of this contract by the Client, whereupon any remaining unpaid balance owed Wedding Ministers, Inc. shall be immediately due and payable in full. In such an event, Client authorizes Wedding Ministers, Inc. to initiate charges to the credit card provided by Client in accordance with the terms of this agreement. Default on the terms of this contract by the Client releases Wedding Ministers, Inc. from any further liability for performance of services and all unpaid tuition and fees shall be immediately due and payable. In the event of default, the Client agrees to pay all costs of collection including reasonable attorney fees. The Program is provided on an “AS-IS” BASIS. Services are provided without warranty of any kind, including without limitation the warranties of NON-INFRINGEMENT, MERCHANTIBILITY, or FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK WITH RESPECT TO THE QUALITY OF THE PROGRAM IS WITH YOU. Neither does Wedding Ministers, Inc. warranty for results or outcomes, including the generation of leads, bookings, or revenue, derived from contracted educational or marketing services including but not limited to the Wedding Minister Certification Training Program, web hosting and design, internet advertising on WeddingMinisters.com, or any other services offered by Wedding Ministers, Inc., for the expressed purpose of promoting the Client’s services and deriving financial considerations to be paid Wedding Ministers, Inc. No representations or promises have been made except those that are set out in the agreement. This agreement may not be modified except in writing signed by authorized agents for Wedding Ministers, Inc. and the Client. This DISCLAIMER OF WARRANTY constitutes an essential part of this License. This agreement is a legally binding document when signed by the Client and accepted by Wedding Ministers, Inc., which is not a public institution. Your signature on this agreement acknowledges that you have been given reasonable time to read and understand this document and that you have read the descriptions of the Wedding Minister Certification Training Program classes including all material facts concerning the Program which are likely to affect your decision to enroll. This agreement shall be governed by the laws of California. If any part of this agreement is adjudged invalid, illegal, or unenforceable, the remaining parts shall not be affected and shall remain in full force and effect. This agreement shall be binding upon the parties, and upon their heirs, executors, personal representatives, administrators, and assigns. No person shall have a right or cause of action arising out of or resulting from this agreement except those who are parties to it and their successors in interest. Client, by signing this contract agrees and states that the undersigned Client has either read or had explained the mutual duties and obligations of this contract, and after such reading or explanation, states that Client is signing this contract with full knowledge of its terms and conditions.
